An exclusive buyer broker is the owner of the real estate firm which represents buyers ONLY. These firms are known as EBAs which stands for Exclusive Buyer Agency (notice it does the A does not stand for agent). Agency identifies the type of brokerage business.
WHAT IS A EXCLUSIVE BUYER’S AGENT?
An exclusive buyers agent works under the authority of an exclusive buyer broker, who may be also be the owner of the firm. Beverly Howe is an exclusive buyer broker and owner of Florida Buyer Broker.
WHY IS IT EXCLUSIVE?
The word exclusive is used to describe either the buyer broker or the buyers agent to the consumer public when the buyers side of the purchase will be represented exclusively in the buyer best interest. The word exclusive does not mean expensive. It is used to describe a type of “Single Agency” service provided by the real estate brokerage firms to the consumer public. Exclusive describes a “Single Agency” brokerage firm which ONLY represents buyers or sellers side of real estate transactions, but NEVER BOTH. Exclusive buyer brokers or exclusive buyer agents only represent buyers. They never list seller’s property for sell.
In the State of Florida only a buyers broker or buyer agent can legally negotiate for the lowest price and best terms for the buyers. The buyers broker or buyers agent must take care of the buyers’ best interest. Only a buyer broker or buyer agent is required to keep the buyer’s financial status and motivation to buy confidential. Florida Buyer Broker always takes the buyers side exclusively. WHAT IS SINGLE AGENCY?
Single Agency means the real estate firm is not intending to represent the buyer and the seller at the same time. They intend to represent the buyer or the seller, but not both in the same transaction.
However, most Single Agency real estate firms list properties for sale and will offer the buyer Single Agency when they first meet the buyer. They have designed a form which says they will be a Single Agent with an addition to the Single Agent form at the bottom which allows the buyers agent to switch to a Transaction Agent. The switch usually happens after the agent has obtained the buyers financial information and motivation to buy. That way the real estate agent can represents themselves as a buyers agents. Then if someone in the buyers agents office list a property in the buyers price range and the buyer is interested in it the buyers agent can switch to a Transaction Agent who no longer represents the buyer but becomes a middleman in the transaction.
WHAT IS A TRANSACTION AGENT?
The State of Florida assumes all buyers and sellers know; all Florida real estate brokers and agents are considered to be “Transaction Agents,” who are facilitators who never represent the buyer or the seller. They have virtually no liability in the real estate transaction.
Transaction Agents are NOT required to tell you they are Transaction Agents or to disclose to you in writing because, they DO NOT represent you. Transaction Agents do not offer the consumer public fiduciary duties or representation. See Fiduciary Duties.
Only Single Agents representing buyers as Buyers Brokers or Buyers Agents are required to make written disclosure to the buyers when they meet. There is a sample of the Single Agency Disclosure form on my homepage menu bar. See Single Agent Disclosure. The form is a disclosure is not a contract. It is a statement of facts to inform the buyer or seller the broker or agent they are working with owes them the fiduciary duties listed on the Single Agency Disclosure. Florida Buyer Broker is a Single Agency firm representing buyers only. We never “bait and switch” from Single Agent to Transaction Agent.
Florida Buyer Broker does not represent any seller’s real estate for sale. Any properties you find on or through this website are via the cooperation of the REALTOR® MLS data base or provided by builders. Some developers and builders market their properties without listing them in MLS. With their permission they are posted on this website. Builders and developers do not sell their properties for less to a buyer who goes to their development without a buyer broker or buyers agent to assist them.
HOW DOES FLORIDA BUYER BROKER GET PAID?
Florida Buyer Broker, exclusive buyers broker office, is compensated by the real estate commission already built into the property by the seller’s agent, builder or developer. The sellers agent includes the real estate commission in the price of the property. When the listing is entered into the REALTOR® MLS data searching system the sellers’ listing agent offers to share their commission with all other real estate agents including buyer brokers and buyer agents.
Florida Buyer Broker is always a Single Agent representing buyers only. We never “bait and switch” from Single Agent to Transaction Agent.
WHAT IS AN ACCREDITED BUYERS AGENT
An Accredited Buyers’ Representative (ABR) does not mean the agent is an “exclusive” buyers agent. They may also list sellers properties and may need to change from a Buyers Agent to a Transaction Agents who can no longer represent the buyer when there is a listing in their office which is of interest to the buyer. The ABR has completed classes to make them better salespeople working with buyers. The designation is given by the National Association of REALTORS®. In Florida the class teaches Transaction Agency. In other States it may be legal to teach dual agency were the buyer and seller are represented I the same transaction.
WHAT IS A BUYER BROKER AGREEMENT?
Working with an exclusive buyers broker or exclusive buyers agency guarantees the buyer full representation. Florida Buyer Broker DOES NOT require a written buyer broker agreement, buyer agent contract or retainer fee. Many other offices will have advance fees for buyers agent and buyer broker services. Other offices may require a written agreement. Buyer Broker Agreements or Contracts may require the buyer to pay the balance of buyers agent or buyer broker compensation as agreed upon in the Buyer Broker Agreement. They are written to protect the buyer agent and buyer broker, not the buyer. Florida Buyer Broker earns the buyers’ loyalty and accepts the shared commission offered by the sellers listing agent, the builder or developer as total compensation.
